ADMINISTRATIVE INFORMATION

Provenance: The Johnson City Judge's Dockets, deposited with the Archives of Appalachia on March 22, 1984, by John Campbell, assistant city manager, and cataloged as accession number 203, were combined with the City of Johnson City Records that were deposited with the Archives June 10, 1987, by Mayor Thomas McKee. The combined records were opened to researchers in June of 1988. An addendum to the City of Johnson City Records was deposited with the Archives January 22, 1990 by Vickie Hames, city records manager, and opened to researchers June 12, 1990. A second addendum to the City of Johnson City Records of audio cassettes and ordinances was deposited with the Archives of Appalachia on March 3, 1994 by Vickie Hames, city records manager, and nineteen tax ledger of city tax payers were deposited on August 29, 1995.

Processing Information: Ed Speer completed processing and the records were opened to researchers in June of 1988. Scott Schwartz revised the finding aid in 1990. Annie Webb and Georgia Greer completed processing the second addendum in February 2002.

HISTORICAL NOTE

Located in Washington County, Tennessee, Johnson City is one of three major industrial-agricultural communities of eastern Tennessee, whose population has grown to 49,500 since its first incorporation during the mid-nineteenth century. The town was originally named Johnson's Depot after the community's postmaster and entrepreneur, Henry Johnson (1809-1874), who was responsible for the building of the town's first depot beside the East Tennessee and Virginia Railroad in the mid-1850s. In 1869 the community's leaders decided the town needed a "more adequate system of government" and requested from the state's General Assembly a charter to incorporate with a "mayor, four aldermen, and a magistrate under the name of Johnson City." Their petition was granted that same year, but the charter was revoked by the General Assembly in 1879 because the city was unable to maintain continued fiscal growth as was outlined by the state's incorporation act. Consequently, Johnson City reverted back to the status of a "taxing district" of Washington County.

In 1885 the town of Johnson City was successful in their efforts for a second incorporation: an act that provided for the popular election of a mayor, five aldermen, one town constable, and one county magistrate. Two years later, the town charter was amended to provide for the election of seven aldermen, a city attorney, appointment of a marshall and city policemen, the construction of new streets; but this amended charter was not approved by the state legislature until 1889. With few modifications, this charter and the governmental powers of the Johnson City leaders remained unchanged for the next two decades.

The first major changes in the government of Johnson City were proposed by the state legislature in 1919. The state proposed the creation of a Board of Commissioners, which would exercise all executive, administrative, legislative, and judicial powers that formerly had been held by the Board of Mayor and Aldermen. This proposal also specified that the executive and administrative powers were to be equally distributed among three city departments: public affairs; accounts and finance; and streets, public improvements, and public property. In addition to these precincts, the legislature also gave the board the authority to require the duties of the city judge to be enforced by the recorder or any other designated city official. On May 6, 1919 the residents of Johnson City approved the proposed charter amendment by a vote of 244 to 159 and six weeks later--June 18, 1919--the voters returned to the polls to elect the first Board of Commissioners for Johnson City.

The adoption of a new city charter in 1939 constituted the second major change in Johnson City's government. The new charter provided for the popular election of five commissioners who would then elect one of their peers to serve as the city's mayor. In addition to this provision, the charter also provided for either the appointment or election of a city manager who would serve as the administrative head of the municipal government under the supervision of the board of commissioners. The charter set the precedent for establishing city and juvenile courts, a seven-member board of education, and a civil service commission for the regulation and control of the police and fire departments. Six city departments were also created by the new charter: finance, public safety, public works, public welfare, education, and public utilities.

SCOPE AND CONTENT NOTE

Original Acquisition: The City of Johnson City Records contain administrative and judicial documents of the government of Johnson City, Tennessee. The collection includes city court dockets, minutes of the Board of Mayor and Aldermen and the succeeding Board of Commissioners, ordinance books, tax and assessor's ledgers, and miscellaneous documents. Some non-city records, encompassing business financial ledgers and United States Housing Authority phonograph discs, were included with the collection. The records were created during the period from 1890 to 1973.

The records reflect the legislative and judicial functions of the Johnson City government. Information regarding the regulation and sale of alcohol, the provision of utility services, improvement of city streets, personal and business taxation, appointment of individuals to public office, passage of city ordinances, and the appropriation of funds is also included among these documents. The tax and assessor ledgers are of particular interest because they provide information on individual property ownership within the city limits. The city court dockets document a broad array of local crimes ranging from assault and battery to prostitution and vagrancy.

Organization: The records are organized into five series: Series I, Recorder's and City Judge's Dockets; Series II, Minutes of the Board of Mayor and Aldermen and the Board of Commissioners; Series III, Ordinance Books; Series IV, Tax Books and Assessor's Rolls; and Series V, Miscellaneous Records. The three phonograph discs have been placed at the end of the last series.

First Addendum: The first addendum to the City of Johnson City Records contains the working copies of the city's ordinances, street labor tax receipts, tax ledgers, legislative acts, certificates, correspondence, annual financial reports and budgets, contracts and agreements, bonds and oaths of office, contract bids, street improvement bonds, refunding bonds, and 612 photographs documenting the general operation of the city's government between 1917 and 1980. The bulk of these records depict the city's financial management of many of its construction projects during the 1920s and 1930s. The ordinances included with this addendum are duplicate copies of those ordinances included with the original acquisition; there are, however, numerous instances where marginalia has been attached to these records clearly illustrating the amending process that was involved in the drafting of specific ordinances.

Organization: The addendum falls into three of the previously designated series of the original acquisition and two new series: Series III, Ordinances, 1909-1968; Series IV, Tax Books and Assessor's Rolls, 1974-1980; Series V, Miscellaneous Records, 1920-1988, Series VI, Annual Audit Reports and Financial Statements, 1917-1977. The photographs have been removed from the collection and placed in the photograph storage area; they are identified by the accession number.

Second Addendum: The second addendum to the City of Johnson City Records contains the taped minutes of the Board of Mayor and Aldermen and the Board of Commissioners, working copies of the city's ordinances, tax ledgers, and financial statements.

Organization: The second addendum falls into four of the previously designated series of the original acquisition: Series II, Minutes of the Board of Mayor and Aldermen and the Board of Commissioners, 1981-1991; Series III, Ordinances, 1968-1979; Series IV, Tax Books and Receipts, 1981-1986; and Series VI, Annual Audit Reports and Financial Statements, 1968-1979.

SERIES DESCRIPTION

Series I, ORIGINAL ACQUISITION, RECORDER'S AND CITY JUDGE'S DOCKETS, 1891-1895 AND 1908-1939, Ledgers 1-29.

The Recorder's and City Judge's Dockets contain formal abridged records of cases involving violations of either the ordinances and bylaws of the city of Johnson City or the criminal laws of the state of Tennessee. Information recorded in the dockets includes the date and number of each case, the plaintiff's and defendant's names, the offence, the name of the city judge, the arresting officer(s), the fine (and/or bill of costs), the amount of the fine and date paid, and remarks. Within each docket the cases are arranged chronologically and assigned consecutive numbers. The ledgers are arranged chronologically, with the exception of volume 1. All the volumes are indexed by the defendant's name.

Series II, ORIGINAL ACQUISITION, MINUTES OF THE BOARD OF MAYOR AND ALDERMEN AND THE BOARD OF COMMISSIONERS, 1890-1970, Ledgers 30-56.

Series II consists of the minutes of the meetings of the Board of Mayor and Aldermen (January 3, 1890-July 2, 1919) and its successor, the Board of Commissioners (July 2, 1919-February 5, 1970). The minutes of the Board of Commissioners begin on page 456 of volume 8 of the minutes of the Board of Mayor and Aldermen. Among the subjects covered in the series are: committee reports; election or appointment of city officials; issuance of bonds; equipment purchases; consideration of petitions; budgets; street improvements; approval of estimates, bids, bills or contracts; adoption of ordinances and resolutions; resignation of city officials or employees; ordinance hearings; beer license approvals; suspension or firing of city employees; and establishing salaries for city officials. The volumes are arranged chronologically with the exception of volumes 30-32; all the ledgers are indexed. One fragile volume is stored in an oversized box.

Series II , SECOND ADDENDUM, MINUTES OF THE BOARD OF MAYOR AND ALDERMEN AND THE BOARD OF COMMISSIONERS, 1981-1991, Boxes 48-64 and tapes 1-599.

The Series II, Second Addendum consists of minutes of the Board of Mayor and Aldermen and the Board of Commissioners recorded on tape. The tapes are arranged chronologically.

Series III, ORIGINAL ACQUISITION, ORDINANCE BOOKS, 1895-1903 and 1909-1968, Ledgers 57-64.

The ordinance books contain the ordinances adopted by the Board of Mayor and Aldermen (1909-1919) and the Board of Commissioners (1919-1968). The ordinances are recorded chronologically in the order of their adoption and were assigned consecutive numbers. Among the subjects covered in this series are bond authorizations; appropriations to various city departments; opening, extension, widening, and closing of city streets; collecting delinquent revenues; setting tax rates; parking regulations; repeal or amendment of existing ordinances; condemnation of buildings, electrical, fire prevention and plumbing codes; fluoridation of water; and prohibiting the sale of beer to minors. The ordinance books are arranged chronologically and indexed by subject.

Series III, FIRST ADDENDUM, ORDINANCES, 1925-1968, Boxes 1-12.

The addendum to series III contains the working copies of the ordinances that were passed by the Board of Commissioners before they were entered into a permanent ledger (see series III original acquisition). These working copies contain marginalia and attachments that clearly illustrate the gradual evolution of specific ordinances as they were successfully passed from one reading to another. The records are arranged sequentially by ordinance number.

Series III, SECOND ADDENDUM, ORDINANCES, 1968-1979, Boxes 37-44.

The Series III, second addendum contains the working copies of the ordinances that were passed by the Board of Commissioners before they were entered into a permanent ledger (see Series III original acquisition). These working copies contain marginalia and attachments that clearly illustrate the gradual evolution of specific ordinances as they were successfully passed from one reading to another. The records are arranged sequentially by ordinance number.

Series IV, ORIGINAL ACQUISITION, TAX BOOKS AND ASSESSOR'S ROLLS, 1922-1973, Ledgers 65-129.

Series IV consists of the Tax Books (1922-1973) and the Assessor's Rolls (1960-1971) of the city of Johnson City. The types of information recorded in the tax books includes: the taxpayer's name, the description and address of each parcel of property (street or avenue, name of addition, block number, and lot number); the assessed value of each parcel of property; the property tax and discount, penalty or interest; the amount of taxes and cost paid; the date paid; and the serial number. The assessor's rolls contain the name and address of each taxpayer, the description and address of each taxpayer's property, and the valuation fixed by the city tax assessor. In both the tax books and assessor's rolls, the entries are arranged in alphabetical order by the taxpayer's surname. The ledgers are arranged first chronologically and then alphabetically by volume title.

Series IV, FIRST ADDENDUM, TAX BOOKS AND RECEIPTS, 1915 AND 1974-1980, Box 12 and Ledgers 138-152.

The addendum to series IV contains 1915 street labor tax receipts and 15 tax ledgers documenting Johnson City's collection of revenues from 1915 and 1974 to 1980. The street labor tax receipts are arranged sequentially by receipt number and the tax ledgers are arranged chronologically by fiscal year. The entries in the tax books are alphabetical by the taxpayer's surname.

Series IV , SECOND ADDENDUM, TAX BOOKS AND RECEIPTS, 1981-1986, Ledgers 156-174.

The Series IV, second addendum, contains Tax Ledgers documenting Johnson City's Collection of Revenue from 981-1986. The entries in the tax books are alphabetical by the taxpayer's surname.

Series V, ORIGINAL ACQUISITION, MISCELLANEOUS RECORDS, 1890-1971, Ledger 131- 137 and 3 photographic discs.

Series V consists of records of Johnson City and records not generated by the city government. The miscellaneous city records include a bond register, equalization board minutes, and an "enumeration of scholastic population" in the city. Also included are a business cash book, an unidentified journal, an appraisal of a corporation's physical property, and three phonograph discs distributed by the United States Housing Authority. The volumes are arranged alphabetically by title. Some fragile ledgers are stored in oversized boxes.

Series V, FIRST ADDENDUM, MISCELLANEOUS RECORDS, 1923-1988, Ledgers 153-155 and Boxes 13-16.

The addendum to series V contains correspondence, election returns, pamphlets, reports, meter deposit ledger, and a financial statement ledger documenting miscellaneous business activities and projects performed by the city between 1923 and 1988. In addition to these records there are several file folders containing House and Senate Bills from the state legislature and charters that illustrate the gradual developments and changes within the city's government between 1923 and 1951. The records are arranged alphabetically by document type and then chronologically by span date within each group of records.

Series VI, FIRST ADDENDUM, ANNUAL AUDIT REPORTS AND FINANCIAL STATEMENTS, 1925-1987, Boxes 17-22.

Series VI contains the annual audit reports and financial statements of Johnson City documenting the city's yearly fiscal activities between 1925 and 1987. In addition to these reports, there are Annual Budget Reports documenting the city's planned budgetary expenditures between 1980 and 1984, and Improvement District Reports illustrating specific types of expenditures for some of the city's consolidated and utility district between 1925 and 1978. The records are arranged in alphabetical order by document type; annual reports, budget reports, and improvement district reports; and then chronologically by span date within each of these groups of documents. The improvement district reports are arranged by report number and are located at the end of this series.

Series VI, SECOND ADDENDUM, ANNUAL AUDIT REPORTS AND FINANCIAL STATEMENTS, 1968-1979, Oversize Boxes 45-47.

Series VI, second addendum, contains financial statements of Johnson City documenting the city's fiscal activities between 1968 and 1979. The records are arranged in reverse chronological order.

Series VII, FIRST ADDENDUM, CONTRACTS, AGREEMENTS, AND BONDS, 1908-1977, Boxes 22-34.

Series VII contains contracts, agreements, oaths and bonds of office, bid and performance bonds, street improvement bonds, refunding bonds, and miscellaneous warranty bonds documenting a wide range of construction and street maintenance projects, the city's bid process, and contracting procedures between 1908 and 1977. The records are arranged by document type into six different subseries: Subseries VII-A, Contracts and Agreements, 1908-1956; Subseries VII-B, Bonds and Oaths of Office, 1917-1977; Series VII-C, Bid and Performance Bonds, 1924-1930; Subseries VII-D, Street Improvement Bonds, 1923-1930; Subseries VII-E, Refunding Bonds, 1919-1945; and Subseries VII-F, Miscellaneous Bonds, 1907-1954.

Subseries VII-A, CONTRACTS AND AGREEMENTS, 1908-1956, Boxes 22-25.

Subseries VII-A contains contracts and agreements between the city of Johnson City and various contractors for the construction and maintenance of municipal property. The material covers a broad span of topics ranging from the building of new schools to garbage removal. The documents are arranged chronologically by contract date. Whenever a set of records documenting a specific type of contract work were originally grouped together covering a large date span, they were filed as a complete unit, identified by project and placed within the chronological folder sequence by the earliest dated contract.

Subseries VII-B, BONDS AND OATHS OF OFFICE, 1917-1977, Boxes 26-28.

Sub-series Vii-B consists of oaths of office and performance bonds used as formal contracts between the city of Johnson City and its elected and appointed government officials. The bonds and oaths of office are arranged chronologically by the date the agreement was signed.

Subseries VII-C, BIDS AND PERFORMANCE BONDS, 1924-1930, Boxes 29-30.

Subseries VII-C contains private and industrial bids for various Johnson City construction and maintenance projects ranging from the addition to the Science Hill High School to the auditing of the city's account books. The bids are grouped together by the name of the proposed project. The records are arranged chronologically by the date the bids were received by the city's administration.

Subseries VII-D, STREET IMPROVEMENT BONDS, 1923-1930, Boxes 30-32.

Subseries VII-D consists of bids, contracts, bonds, and blueprints for various street improvement projects executed by the city of Johnson City between 1923 and 1930. The records are arranged chronologically by the date the contract was signed by the construction company and the city's administration. Miscellaneous documents documenting different aspects of street improvement are located at the end of this subseries.

Subseries VII-E, REFUNDING BONDS, 1919-1945, Boxes 33-34.

Subseries VII-E contains correspondence, legal opinions, bond inventories, and bonds documenting the city of Johnson City's purchase and sale of municipal bonds to fund various construction projects between 1919 and 1945. Of particular interest are three folders of material depicting the city's management of a 3 million dollar debt tied to its waterworks utility. The records are arranged chronologically by date; the material documenting the waterworks debt, encompassing dates between 1936 and 1938, have been kept together and placed after the 1936 files but before the remaining files that begin with 1937.

Subseries VII-F, MISCELLANEOUS BONDS, 1907-1954, Box 34.

Subseries VII-F contains miscellaneous warranty bonds for various completed construction projects. The records are arranged chronologically by the date the bond was signed.
