Employees Called to Active Military Duty

Governor Bredesen recently called the National Guard into active military duty in accordance with TCA 58-1-106 in support of the states affected by Hurricane Katrina. The disaster recovery assistance services to be performed are part of the Emergency Management Assistance Compact codified in TCA 58-2-403. Executive Order Number 26 provides that employees of each department in the Executive branch of state government who are members of the National Guard and are called by the Governor to state active service as part of the Emergency Management Assistance Compact to provide disaster recovery assistance services to states affected by Hurricane Katrina shall, while on such active military duty, be entitled to special leave with partial pay. To the extent possible, partial pay shall be the difference in the employee's regular state salary and the employee's full time military salary, with a minimum monthly amount sufficient to keep in full force and effect all benefits that the employee had on the date of call to active military duty.

This special leave with partial pay will be administered in a similar manner as employees currently covered by Executive Order Number 26 as part of Operation Enduring Freedom (OEF) and will be in effect for one year from September 1,2005. In order to be eligible, employees must provide orders calling them to duty as part of "Operation Hurricane Katrina EMAC Agreement". Employees will need to contact their agency Personnel Officer to assure the appropriate processing of compensation due as part of participating in this operation.
