STATEMENT OF RATIONALE FOR JUDGMENT OF COMPLIANCE
East Tennessee State University seeks and develops administrative officers
with the qualifications to assist the institution in achieving its vision
and mission. Employment and development are based on locally developed
job descriptions (ETSU Job Descriptions for Administrative/Professional
Positions)and guided by specific hiring procedures and annual evaluation
processes. Procedures for hiring administrative officers and staff at
ETSU (Personnel Manual, Guidelines for Filling Administrative Vacancies)
are in compliance with the Tennessee Board of Regents (TBR) policies and
guidelines (TBR Manual, General Personnel Policy) andare designed
to ensure that previously defined qualifications are realized and appropriate
to each job. Annual evaluations of ETSU administrative officers and staff
serve to assess job performance and to guide continued development of
their leadership and management skills (SACS Standard III-10).
The President of ETSU has the authority and responsibility regarding
personnel matters that are necessary and appropriate for the efficient
administration of the institution (TBR Manual, General Personnel).
The Tennessee Board of Regents is responsible for the selection and retention
of qualified university and college administrators as presidents of the
TBR institutions (SACS Standard III-2). East Tennessee State University
observes and promotes principles of equal employment opportunity in all
hiring practices and is fully in accord with the belief that educational
and employment opportunities should be available to all eligible persons

At ETSU, locally designed job descriptions identify the education, skills,
and experience qualifications for each administrative position. The ETSU
Office of Human Resources maintains current job descriptions for all administrative
and staff positions (ETSU Job Descriptions for Administrative/Professional
Position). Both searches for and annual evaluations of administrative
officers and staff are guided by these descriptions.
East Tennessee State University has explicit procedures for recruiting
and hiring administrative officers (ETSU Personnel Manual, Content
and Purpose; Guidelines for Filling Administrative Vacancies). These
procedures are in compliance with current TBR policies and guidelines
and with applicable state and federal laws. A summary of the hiring process
is, as follows:

A search committee is formed that includes representation of appropriate
offices and constituencies (e.g., administrators, faculty, students).

A position advertisement is composed, based on qualifications included
in the job description(ETSU Job Descriptions for Administrative/Professional
Position).

Each position is advertised, listing pre-determined qualifications,
in sufficient and appropriate publication outlets (Request to Advertise).

Applicants are screened based on pre-determined qualifications.

A list of potential interviewees is submitted to the ETSU Affirmative
Action Office. The Affirmative Action Director is responsible for
review of applications, based on advertised qualifications, and then
certifies those candidates qualified for interviews (Certification
of Applicant Pool). The applicant pool for department
chairs and for upper-level administrators must also be approved by
the TBR (TBR Manual, Personnel Transactions and Recommended Forms).

Interviews are conducted.

The search committee may recommend one or more of the interviewees
for hire.

A request to hire is approved by the Affirmative Action Director,
the president (or his designee), and the Tennessee Board of Regents
(Request to Hire Support or Administrative Staff). Appointments
of vice presidents; chief business officers/managers; academic and
administrative deans; and academic department/division heads require
the prior approval of both the president and the chancellor (TBR
Manual, General Personnel).
Documents gathered during the search process with regard to the qualifications
of the employed individual are placed in his or her personnel file. Documentation
for each search is maintained in the ETSU Office of Human Resources.
