for and exercises appropriate administrative and fiscal control over the
institution's intercollegiate athletics program.

STATEMENT OF RATIONALE FOR JUDGMENT OF COMPLIANCE
At East Tennessee State University, the chief executive
officer (president) has ultimate responsibility for all intercollegiate
athletics programs (TBR Manual, Duties of the Presidents). The
Director of the ETSU Department of Intercollegiate Athletics reports directly
to the president (ETSU Organizational Structure) and they meet
regularly for exchange of information. The athletic director also is
included as a member of two ETSU standing committees---the President's
Council (composed of all upper-level administrators) and the Senior
Staff (composed of vice presidents and others who report directly to the
president). The president exercises appropriate administrative and fiscal
control over the institution's intercollegiate athletics programs. In
addition to the relationship with the athletic director, this charge of
the president is facilitated by the roles of the Intercollegiate Athletics
Standing Committee, the National Collegiate Athletics Association
Faculty Athletics Representative, and the financial reporting structure
of ETSU.
The Intercollegiate Athletics Standing Committee
(IASC) reports directly to the president and is charged with recommending
policies and procedures relating to the university's participation in
intercollegiate athletics. The chair of IASC is elected by the committee
membership and, traditionally at ETSU, is the NCAA Faculty Athletics Representative.
Each NCAA Division I institution is required to have a faculty representative
who shall be a faculty member (or administrator with faculty rank) not
associated with the athletics department (NCAA Manual). The NCAA
requires that individual institutions determine the specific duties of
faculty representatives. At ETSU, the faculty representative is active
in the business of the Intercollegiate Athletics Department, traditionally
serves as chair of the IASC, is involved in strategic planning, and serves
on all search committees. In these capacities, the ETSU faculty athletics
representative also may communicate directly with the president. After
review, we suggest that a more formal job description specifying the accepted
role of the faculty representative at ETSU is needed in the ETSU Department
of Intercollegiate Athletics Policies and Procedures Manual.
Another member of the Intercollegiate Athletics
Committee is the president of the Student Athletic Advisory Committee
(Constitution), which exists to serve as an advocate for student
athletes (including cheerleaders and student athletic trainers) and to
provide a channel of communication between student athletes with the athletic
administration and faculty. This committee can present student concerns
to the director of intercollegiate athletics, the faculty athletics representative,
the IASC, or any other university administrator, including the president.
While this is not a specified direct reporting relationship, the framework
of the association provides opportunity for providing pertinent information
directly to the president, if needed. After review, we suggest that the
president consider a formal meeting arrangement with the Student Athlete
Advisory Committee for the purpose of sharing information.
As a member institution of the Southern Conference
and the NCAA, ETSU must abide by significant regulations that affect the
president's ultimate responsibility for intercollegiate athletics. For
instance, if any apparent violations of NCAA regulations occur at ETSU,
the president is notified in writing (ETSU Department of Intercollegiate
Athletics, Policies and Procedures Manual).
The president exercises appropriate fiscal control
over the institution's intercollegiate athletics program. Summary management
reports of the current financial status of the institution are made available
as needed, but are reviewed by the president no less frequently than monthly
(TBR Manual, Budget Control). The president is responsible for
approval of the yearly budget requests from intercollegiate athletics.
Intercollegiate athletics activity is subject to the same fiscal requirements
as all other ETSU units (ETSU Financial Procedures Manual). Further
fiscal control is ensured by three additional requirements. First, the
associate vice president of business and finance has direct oversight
of contracts and foundation accounts. Second, the assistant vice president
and director of budgets reviews all athletic department purchase requisitions.
Third, athletic revenues and expenditures are among the activities that
are subject to risk analysis and internal audit (TBR Manual, Internal
Auditing).
The ETSU Pirate Club raises funds for scholarships
for athletic programs. All disbursements of gifts are in accord with
policies of the ETSU Foundation (ETSU Pirate Club, Bylaws)
and in compliance with local conference and NCAA regulations. The ETSU
President is a member of the Pirate Club board of directors and either
he or his designee is in regular attendance at all board meetings.
