materials, faculty compensation, copyright issues, and the use of revenue
derived from the creation and production of software, technologically
delivered courses, or other media products.

STATEMENT OF RATIONALE FOR JUDGMENT OF COMPLIANCE
Information concerning ownership, compensation, copyright
issues, and revenues derived from the creation and production of software,
technologically delivered courses, or other media products is clearly
presented to the faculty of East Tennessee State University. General information
is easily accessible in the ETSU Faculty Handbook and A Faculty
Guide to Copyright Fair Use. Three additional documents specifically
describe ETSU policies concerned with the ownership of software and technologically
delivered courses (ETSU Memorandum of Understanding Regarding an Internet-Based
Course or Courses; ETSU Policy on Patents, Copyrights, and Trademarks;
Form for Disclosure of Material to be Copyrighted). These ETSU policies
include clear definitions of faculty and university ownership of copyright,
specifications of the division of revenues between the faculty member
and the university, procedural statements, and forms that direct a faculty
member through the process. The ETSU offices of Distance Education
and Research and Sponsored Programs are available to assist
and advise faculty members. The ETSU Research Development Committee
serves as the university advisory committee on patents, copyrights, and
trademarks.
The policies of ETSU are in accord with policies of
the Tennessee Board of Regents (TBR). A general policy provides guidance
for ownership of copyrightable materials (TBR Manual, Patents and Copyright).
A guideline describes the legal rights and responsibilities of creators
and distributors of distance education materials in the TBR system (TBR
Manual, Distance Education and Intellectual Property). This guideline
also defines distance education work-for-hire, which covers production
of video materials used for distance delivery via television.
