institution publishes a clear and appropriate statement of student rights
and responsibilities and disseminates the statement to the campus community.

STATEMENT OF RATIONALE FOR JUDGMENT OF COMPLIANCE
East Tennessee State University publishes and disseminates
a comprehensive set of policies and regulations that govern student rights
and responsibilities (sections on Student's Bill of Rights, ETSU
Undergraduate, Graduate, and Quillen College of Medicine catalogs; ETSU
Spectrum). The ETSU Spectrum sets forth student rights
and responsibilities under the following major headings: Institution Policy
Statement, Disciplinary Offenses, Academic and Classroom Misconduct, Disciplinary
Sanctions, and Disciplinary Procedures.
A formal review process for policies and regulations
that impact student rights and responsibilities is initiated annually
by the Tennessee Board of Regents' general counsel, who requests review
of institutional policies and rules (TBR General Council Notification
Letter). Upon receipt of this request, the leadership in the division
of student affairs and university legal counsel undertake review of all
appropriate ETSU policies. Revisions of rules must be approved and recommended
by various institution administrators, the university president, TBR general
counsel, and the TBR chancellor prior to review by the entire board.
Following approval by the TBR, revisions are submitted to the Tennessee
Secretary of State and incorporated into the Tennessee Code.
The ETSU Student's Bill of Rights delineates
certain rights guaranteed by federal and state constitutions and the Tennessee
Board of Regents (TBR Manual, Policy Insuring Student Due Process Procedure).
Although there is no national standard for the statement of student rights
and responsibilities, legal circumstances result in a high degree of consistency
of these statements among institutions. The ETSU Student's
Bill of Rights is consistent with that of other institutions of higher
education.
